Helen Dye, Member, State Planning Commission

Presentation on the Implementation of the New State Planning System, in relation to

Hahndorf State Heritage Area and Conservation Zone

  • Helen reported that the new Planning Infrastructure Act set up the independent State Planning Commission.

  • She outlined the Commission's membership and their background skills and experience

  • Role is to inform the Department (DPTI) and Government, and to be aware of diverse Community views

  • Commission has had to address the issue of Contributory Items

  • Alex discussed the context of the reform, with 68 Councils and 4 Outback areas all having differing Development Policies and Plans

  • Aim to transition ‘good policies' into the new Planning Code

  • Huge volume (> 1500) policies and layers to the current code – aim is to reduce to approximately 60

  • Issue of lack of timely response to change. Can take 2 -3 years. Aim is to improve the policy to address the response time : a State wide code provides opportunity for an improved time frame for change

  • E Planning. System is currently paper based, will be moving to a digital system with ability to lodge, assess and monitor applications on line. Will be able to enter an address on web site to view all Planning data and rules applicable to that address.

Malcolm stressed the need to protect Hahndorf’s Heritage status for the benefit of the State, residents, traders and >1 million visitors each year.

Dan queried where the 12,000 Contributory Items sit within the new Code

  • Nadia stated that there are existing State and Local Heritage items and areas. For Hahndorf, the new State Heritage area overlay will sit over the current State Heritage area (Main Street and part of Victoria Street)

  • Existing State Heritage places will be transitioned to the new Heritage place overlay.

  • DPTI are working with State Heritage to develop the code

  • Stressed that overlay takes precedence

  • State Heritage – there will be increased powers vested in the Minister for Heritage. Currently holds ‘Power of Regard’, where Minister's decision can be overridden. Under the new system, Minister will have ‘Power of Direction', which can override a planning recommendation.

  • The proposed overlays are currently available to view, and further consultation will be possible.

  • Existing Local Heritage areas will transition to the Local Heritage overlay, and will incorporate demolition control, and strong test to assess applications, including a Heritage assessment of the property. Closely working with Heritage experts.

  • Contributory Items. Mt Barker Council currently has 209 Contributory Items

  • Numbers vary across Councils – may have collective Heritage value or be an individual item. Could be buildings(s), tree, etc

  • If Contributory Items are located within a Local Heritage overlay, protection comes from being within that broader area. Ensures any replacements are ‘sympathetic' to existing area, whereas currently there is no control over the style of replacement buildings

  • ‘Character' overlay will be incorporated in code.

  • Helen: Contributory Items don't have the same legal protection status as Heritage items

  • Councils have a window of opportunity under the current system to assess Contributory Items to add to the list of Local Heritage items

  • Once the new Code is adopted, new processes will be in place.

  • There will be no change to the current boundary of the Hahndorf Heritage area.

Discussion/Questions.

  • Narelle – Mt Barker has only 4 Contributory Items sitting outside the existing Local Heritage area. Council will make a decision regarding these items first.

  • There are no Contributory Items in Hahndorf

  • David and Margaret expressed concern regarding the cost to Council of assessing Contributory Items and whether costs will prevent assessments being undertaken

  • Deb queried when consultation about the Heritage code will occur – likely 3rd quarter of 2019. Target issues relevant to Hahndorf community.

  • Dan stated he has received constant reassurance that early consultation will occur. Government are still awaiting the Opposition's response

  • Dan suggested issuing a comparative table outlining current status vs proposed changes.

  • Helen advised that details are not available at present

  • Annette sought clarification that Contributory Items within Local Heritage, Historic Conservation zones, have the same protection as Local Heritage items. Currently applications to demolish are required

  • Narelle – increased oversight/control for demolition and replacement of buildings within protected areas. Review Hahndorf boundaries.

  • Sarenah queried what protection would be available for Indigenous sites – Alex responded that these are protected under the Aboriginal Heritage Site legislation.

  • Sue queried whether economic contribution would form part of the overlay precedence. Alex responded that there will be some policy incorporated around this issue.

  • Malcolm suggested that this information would be ideal for the forthcoming HCA AGM. Alex suggested that Council also be involved. Action: Malcolm, Jean

8. Reports 2018/19

8.1 Council (Narelle Hardingham)

  • Last Council meeting confirmed the Financial Plan, with money allocated to Hahndorf's Soccer Club, Bowling Club, and the Main Street Design Phase, which will go to Community Consultation in December

  • Dementia Friendly proposal

  • Opportunity for Community and Traders to work together – a sculptor has offered to sculpt a statue of Hans Heysen. Narelle encourages closer working relationships between HCA and Traders.

  • Council is liaising with Peter and Sue O'Brien regarding Trail map

David Leach

  • Significant concern expressed by ratepayers over proposed rate increase. Councillors agreed to reduce rates by 1.1% from original proposal

  • Eric offered congratulations to David and Narelle for their efforts to achieve this outcome

8.2 Events (A. Haines)

  • AGM 25th September

  • Discussion re venue – Institute vs St Michael's Hall. Decision to continue with St Michael's as more appropriate for powerpoint presentations.

  • Speakers being finalised.

  • Remembrance Day 11th November. Speaker will be Chairman of Legacy. A grant application has been made to Council

8.3 Financial (E Aliffe)

  • Opening balance $5860

  • Receipts total $1300, expenditure $780

  • Closing balance $6280

  • Eric to arrange Audit of books

8.4 Township Plan

  • On/off freeway ramps: Dan has been advised that there are no plans for an interchange in advance of the traffic study plan being completed

  • Malcolm expressed concern++ that Hahndorf Main Street traffic issues can't be addressed without the interchange issues also being addressed

  • Eric's view is that visitors should park and walk or bus into Hahndorf

  • David sees an opportunity to pursue change with current Federal/State/Council representatives

8.5 Village Voice (W Williams/A Haines)

  • 3 major events being focussed on for next issue

  • Malcolm reinforced its value as means of communication with the Community

8.6 Nixon’s Mill Stage 2

  • No further action

8.7 Yantaringa Reserve Open Space Cycling and Walking Trail (P&S O’Brien)

  • Sue is liaising with Nick Bowman and Stu Clement re trails and their benefits to communities. Both have a background of working with the environment.

  • Council will manage Community consultation – how and when

  • The reserve had been earmarked by Council for trails

  • David confirmed that work will be undertaken on the Western side – rubbish removal, levelling – Council has approved funding for this

  • Council will take control of negotiation between all Stakeholders, and of the development.

  • Council, Narelle and Peter to work together

  • Sarenah queried liaison with Traders – meeting has occurred with Traders – development of Trails will bring benefits to residents, traders and visitors.

10. Other Business

10.1 Bruce Mouatt has resigned as Deputy Chair. Margaret Brook will act in the position, and will chair next meeting.

10.2 Dan commended the Community on achieving a reduction in the proposed Council rate.

10.3 Eric plans to propose HCA holds evening meetings to attract broader attendance. Mike suggested alternating meetings between day and evening
